Staff Attorney

This position involves direct representation of income eligible individuals with disabilities in a variety of areas, including special education (students age 5-21) and the appeal of adverse eligibility decisions pertaining to disability related services/programs through the Office of People with Developmental Disabilities (OPWDD). 

 

The attorney will advocate for appropriate educational programs for students with disabilities, protect the educational rights of homeless students, represent students at residency hearings and in disciplinary matters, and represent adults with disabilities in securing appropriate residential placements and supports.  Duties also include representation at Committee on Special Education meetings, Resolution Sessions and Impartial Hearings, at hearings before the Department of Social Services, drafting  Due Process Complaints, appeals to the NYSED Office of State Review and the NYS Commissioner of Education, Article 78 petitions, Appellate Division appeals and federal litigation papers.


                        

START DATE:         Immediate

SALARY:      $52,458 DOE

REQUIREMENTS: Admission to the New York State Bar is preferable.  Applicants who have passed the Bar Examination and are pending admission will be considered.  Experience and/or interest in educational systems is desirable.  Bilingual proficiency in Spanish and English will be viewed favorably.  Strong analytical and writing skills are essential.
